Social Security Disability Back Pay: How It Works

Helping disability claimants since 1996. Attorney Eitan Dagan has spent 30 years helping people through Social Security Disability claims.

Disability back pay is the money Social Security owes you for the months you were eligible while you waited for approval; SSDI back pay can reach up to 12 months before the month you applied, while SSI back pay starts no earlier than the month after you applied.

SSDI back pay

  • Social Security picks the date your disability began.
  • There is usually a five-month waiting period. Your first benefit is for the sixth full month after that date.
  • SSDI can pay for up to 12 months before the month you applied, if you were disabled and met all the other rules.
  • It also pays for the months between your application and your approval.

SSI back pay

  • There is no five-month waiting period for SSI.
  • SSI cannot pay for the month you applied or any months before. The first possible month is the month after you apply.
  • SSI can pay for the months between then and your approval.

Why you should not wait to apply

Back pay depends on your application date. Every month you wait can be a month that cannot be paid. If you were denied, appealing on time can keep your first application date alive. See Denied? How to appeal.

Fees come only from back pay, and only if you win

No fee unless you win. You will not be charged for case expenses if we do not win your case.

We use the standard Social Security fee agreement. Fees are set and approved by the Social Security Administration. Under that agreement, the fee is 25% of your past-due benefits, up to $9,200.

Back pay (Social Security calls it past-due benefits) is money for the months you were owed benefits while you waited for a decision.

How far back can SSDI back pay go?

SSDI can pay for up to 12 months before the month you applied, if you were disabled during that time and met all the other rules. There is usually a five-month waiting period from when your disability began.

Does SSI pay back pay?

SSI can pay for months after you applied while you waited for a decision. It cannot pay for the month you applied or any months before. The first possible month is the month after you apply.

Is the lawyer’s fee taken from my monthly checks?

Under the standard fee agreement, the fee is based on your past-due benefits only, not your future monthly checks.
